RE: The tariff classification of a men’s suit type jacket from the Dominican Republic.

Dear Mr. Park:

In your letter dated May 1, 2007, you requested a tariff classification ruling on behalf of D K Clothing Int’l Inc. Your sample is being retained for our files.

Style DKDR-0501 is a men’s suit-type jacket constructed from 54% silk, 46% wool, woven fabric. Style DKDR-0501 is constructed from four panels sewn together lengthwise and is fully lined with woven fabric. The suit type jacket features a notched collar with lapels; a full front opening with two button closures; long hemmed sleeves with four buttons on the sleeve placket; an inset pocket on the left chest; two inset pockets with flaps below the waist; inner welt pockets on the left and right chest; and a hemmed bottom with a rear center vent.

The applicable subheading for Style DKDR-0501 will be 6203.39.9020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for men’s or boys’ suits, ensembles, suit-type jackets, blazers . . . suit-type jackets and blazers: of other textile materials: other: other: subject to wool restraints. The duty rate is 6.5% ad valorem.

Style DKDR-0501 falls within textile category designation 433. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
